Legal Bases for Processing

The legal bases on which we process your personal data are:

  • Necessary for compliance with a legal or regulatory obligation that applies to us;
  • Necessary for the performance of a contract with you or in order to take steps at your request prior to entering into a contract with you;
  • Necessary for the purposes of our legitimate interests. For example:
    • in marketing and promoting our products and services and conducting our business in a responsible and commercially prudent manner.; or
    • when Kingspan Group receives a request that is meant to be sent to one of our Affiliates, it is of Kingspan Group's interest to provide you with the best possible service, so it will send the enquiry to the relevant Affiliate for you, instead of asking you to send it again.

We will not process your personal data for these purposes if such legitimate interests should be overridden by your own interests, rights and freedoms; or

  • in limited circumstances, you have given your consent to processing of your personal data, for example, to receive marketing communications by third parties or to consent to the use of Kingspan Group or third-party cookies.

Marketing

We would like to provide you with information about Kingspan’s products and services, and other information from Kingspan, which we think you may find interesting. We may send you such information by post, email, and/or telephone if you agree we can.

With your explicit consent, we will use external organisations to send Kingspan offers and marketing communications to you. To do so, either they will collect information directly from you, or we will otherwise provide your personal information to them. These external organisations include contractors, merchants, distributors, retailers and other service providers which are outside of Kingspan. When we work in partnership with external providers, we decide how to use your personal data together and we are both responsible for complying with the law. If you have any questions about the processing of your data for marketing purposes, please contact the relevant Data Controller. For more information about our external providers and their use of personal data for marketing purposes, please review our Cookie Policy.

You can opt-out from receiving marketing communications at any time. If you have received marketing communications from any of our Kingspan entities and decide that you no longer wish to receive same, please unsubscribe via email link, or by such other means as we may communicate to you.

Please note that as each entity is an independent data controller, we do not as a group operate a global marketing database, which means Kingspan Group is unable to unsubscribe you from marketing from all Kingspan companies centrally.

Who do we share your information with?

Kingspan Affiliates share your personal information with Kingspan Group because Kingspan Group runs the global website.

We may disclose your personal information to third parties located in your country and in countries other than your own, in due compliance with applicable laws.

If we have your explicit consent, we may provide your personal information to external organisations (i.e. to contractors, merchants, distributors, retailers, media agencies and service providers which are outside of Kingspan) so that they can contact you about their promotions, services, events and other activities in relation to Kingspan products and services without having obtained consent from you themselves. An example of this is a provider that places cookies on your device in order to personalise information about our products and services for you.

As we are a global entity, the countries to which your personal data is sent/accessed from may have a different standard of data protection than the country in which you are situated. However, we have put in place protections and adequate safeguards to ensure that your information is adequately protected and we comply with the law. If you wish to know more about the protection we have put in place to keep your information safe, please contact Kingspan Group or the Affiliate you normally deal with. A list of data controllers and their contact details can be found here.

Where organisations outside of Kingspan provide you with a service on our behalf, or help us provide the service to you (e.g. sending you a piece of literature that you have requested from us or helping us respond to your request regarding the technical operation of the website) or provide professional advice to us, we may share your personal information with those organisations who will only use the information to provide the relevant service. However, we will retain control of your personal information and any third party service provider that we use must act in accordance with our instructions and protect the confidentiality and security of the personal information as appropriate.

We may share your personal information with a purchaser or potential purchaser of our business.

We may disclose your personal information to third parties, their agents and professional advisors, subject to confidentiality obligations, for the purpose of a due diligence exercise by third parties in connection with any proposed merger, acquisition, re-organisation or transfer of any part of our business and to any person proposing to participate in, or promote or underwrite or manage any such arrangement.

In some circumstances, we may have to disclose your personal information by law, because a court or the police or other law enforcement agency has asked us for it.

Retention of your information

We only retain your personal information for as long as is necessary for us to use your personal information as described above or to comply with our legal obligations.

Where your personal information is processed with your consent (e.g. for the marketing purposes), such personal information is retained until you revoke the consent for such processing, or until the time limit dictated by law is reached.

Your rights, how to get copies of or amend the information we have collected and how to make a complaint

You may request details of the personal information that we hold about you under data protection laws. If you wish to exercise any of the rights outlined below, please contact your data controller directly, details of which can be found here.

You may oppose the processing of your personal data when there are legitimate grounds to do so, if there is no legal obligation for us to carry out this processing and provided that this right of opposition has not been excluded by an express clause in the document authorising this processing. For the avoidance of doubt, processing for marketing purposes may always be opposed.

If you think any information held by Kingspan about you is incorrect, incomplete or is being processed improperly, please write to Kingspan Group and it will pass on your request to your data controller's, or you can contact your data controller directly and it/they will delete, block, correct, update or cease to process any information subject to the terms provided for by the law.

Where information processing is based on your consent, you have the right to withdraw that consent at any time.

Where our processing of your personal data is based on you having provided consent, or is necessary for the performance of a contract with you, you may request us to provide you, or a third party, with a copy of your personal data in a structured, commonly used machine readable format.

If you wish to make a directive about the handling of your personal information after your death, please let us know and we will oblige.

If you wish to make a complaint about an alleged breach of the law, we ask that you send us your complaint in writing to the Kingspan entity in question at the address shown here. We will respond to complaints and implement any remedies subject to the terms provided for by the law. Separately, you may make a complaint at any time to the data protection authority in the country in which the Kingspan entity in question is based, or the country in which you live.

Security

Kingspan is committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure we have put in place suitable physical, electronic and managerial procedures where relevant to safeguard and secure the information we collect.

If at any point you suspect or become aware of a security incident (e.g. your password for accessing your registered account on this website is stolen or you receive suspicious communication from someone holding themselves out to be a Kingspan employee or from a dupe website claiming to be affiliated with Kingspan), please forward the communication to us or report the incident by email to admin@kingspan.com or in writing to Kingspan Holdings (Ireland) Limited, Dublin Road, Kingscourt, Co Cavan, A82 XY31, Republic of Ireland as soon as possible.
